False arrest question ….?
I went to court on Monday on a charge of domestic abuse. VERBALLY I was arrested for arguing with my boyfriend sheriff's department. was called. My boyfriend and I spoke with Assistant District Attorney, and stated that there was no abuse and the case was dismissed. In fact, the ADA said not even know why he was arrested in the first place. When he apologized to me, I asked her if something pops in my file, and she said she would show, but show how Dismissed. To have this totally out of my subscription, she told me she would have to pay like $ 150 – $ 250 to the courts. Does this sound not justified was charged with anything at all, in fact, I feel like I was falsely accused … Do not I have any recourse or should I let it ride?
I'd say that qualifies as a arrest. The arrest can not be done without at least some evidence of abuse and the verbal exchange is protected by the First Amendment.
